Opposition upset over new NPA head

Opposition parties expressed reservations on Wednesday about the appointment of Menzi Simelane as National Director of Public Prosecutions.

Democratic Alliance spokesperson on justice Dene Smuts was "shocked" at the appointment, as was Independent Democrats leader Patricia de Lille.

"It is difficult to imagine a more inappropriate choice," Smuts said.

De Lille was shocked that President Jacob Zuma could appoint someone "accused by Frene Ginwala's panel of deceiving Brigitte Mabandla, his former boss and justice minister, and of interfering with the NPA's independence".

She was referring to the Ginwala commission of inquiry into the fitness to hold office of Simelane's predecessor, Vusi Pikoli.

Simelane's testimony at that inquiry was slated as "irregular".

Although Ginwala could not find that Pikoli was not fit to hold office, he was fired for not having enough regard for national security.

The Public Service Commission was asked to investigate Simelane's conduct after Ginwala expressed concerns about his interpretation of how far he could interfere in the function of the NPA and his withholding of information from the inquiry.

Justice Minister Jeff Radebe decided not to proceed with the investigation after consulting with the commission.

De Lille said his appointment showed a disregard for the independence of the National Prosecuting Authority.

The African Christian Democratic Party was "extremely disappointed" with the decision, saying Simelane was "surrounded by controversy" during his tenure as director general of the justice department.

"In view of Ginwala's findings, and the need for an independent NPA, the appointment of Advocate Simelane is startling to say the least," said ACDP president Kenneth Meshoe.

The Inkatha Freedom Party said Simelane's appointment "trigger[ed] questions and concerns".

"... his integrity was called into question by the Ginwala Commission, which led to an investigation into his conduct.

"The findings of this investigation must still be made public," said the party.

The IFP found it difficult to understand why Zuma would appoint Simelane when "his conduct is still under the spotlight".

The ANC welcomed the appointment. The ruling party said he brought the "necessary experience, legal background and administrative skills" to do the job.

"The appointment will bring stability to one of the key arms of the criminal justice system," the ANC said.

It wished Simelane well in his new post and thanked outgoing acting director of public prosecutions Mokotedi Mpshe for his work at the helm of the NPA. -- Sapa

Not surprised the opposition are upset ... the entire country should be upset. His appointment simply guarantees that none of the ANC insiders will be prosecuted.

The self admitted 'commies' are taking over, what did you expect. The average citizen does not care about politics, beyond a different race is control now, and so what. Corruption appears to be a way of life, so absolutely no one is surprised. Clearly this is a step-wise, planned and patient process. No one will make any money betting against totalitarian rule by the ANC and control of the media, except perhaps picking the dates that these steps are taken. No President or CEO will ever appoint somebody to critical positions< knowing full well that person may stab him in the back: The DA would never appoint Jesse Duarte as their national spokesperson so why must the Pres appoint somebody just to please the opposition: Democracy is simply majority rule and it seems that our heroic opposition fails to grasp this fundamental point: I suggest our opposition go out to the townships and fall on their knees and ask the masses for forgiveness: Maybe the masses will vote for them and they may soon win an election and appoint their own people to important positions: Somehow I doubt that these small irellevant parties will ever rule this country: They will forever sit on the opposition benches where they will moan and complain about the ANC:

Of course not. This is merely a case of the ANC’s Nomenklatura system of patron/client in action. Simelane’s stratospheric career trajectory shows that he is probably quite a pliable kind of client: someone whom his patron(s) could trust to keep those files with the 700 odd corruption/money laundering charges safely locked away in his office safe. Someone who would also diligently obey his patron(s) suggestion of a tactical leak of those same files, if and when they need to “recall” the much higher placed client implicated in the charges.

All that the Ginwala report did was cast suspicion in questioning the new NDPP's integrity as 'irregular'. This does not constitute anything untoward. If there was ANY doubt about the integrity of Comrade Simelane, President Zuma, in consultation with the ANC, would not have appointed him. We will not be deterred by minor irrelevant excuses of opposition parties. Collectively, they couldn't decide on skwat.

Believe me, I do not care who governs SA, or which skin colour the rulers.
But I am convinced that the evidence that we are entirely on the wrong path, with the wrong leaders is mounting day by day.

In the end it is not important what you or I think.
But we’ll see who is right –because THAT will make a huge difference in millions of lives –screw our respective political views.

It is time for the opposition parties to realize that Zuma and the ANC will continue doing things the way they see fit. Not one of the opposition parties could give one compelling and real reason why Simelane is unfit for this position? Instead they hammering on what Ginwhalla said. In any case regardless of what Ghinwalla said, Menzi is qualified for the job! Vusi Pikoli has been found to be the most incompetent NDPP and was clearly disliked by his colleugues in the national security cluster.

This appointment reeks of corruption and appointing a friend of the party is not going to rid the worldwide reputation South Africa is getting as a corrupt state. Hence the opposition condemnation. Don’t (yet again) make it a racial issue- almost all of the opposition parties were against this appointment (most of them Black). Race has nothing to do with it.

To say that the ANC is in charge so they can do what they want is also a complete contravene of the democratic system. The whole point of democracy is for the opposition to watch the ruling parties moves and criticise when they feel that it is not behaving in manner that will benefit the country as a whole (not the ANC elite). My logic tells me that people from those 64 municipalities you are talking about saw Zuma as someone who is prepared to listen and they went on and expressed their unhappiness. Your proclivities in as far as the ANC led government is concerned are sometimes unclear and devoid of rationale.

The first order of business for our new NDPP, Simelane is to have a serious review of all prosecutors. His mandate should be to rid the NPA of all reactionary and counter revolutionary forces! He should also call a halt to the farcical trial of Jackie Selebi and he should also rescind the section (204)decision of Pikoli which granted amnesty to drug dealers.These guys must stand trial. The DA leaders in the WC are marching against small drug dealers but are amazingly silent about those that receive amnesty from Pikoli (THE REAL DRUG LORDS) who are flooding our communities with drugs!

So Kells even the heroic DA lied to the citizens of the Western Cape! Its regrettable that the everyone who occupied a leadership position in the apartheid regime did not face Neurenberg type trial for their crimes against the indigenous people of this country! 2) Shut up and let the government do what is elected to do.
3) Do some research and find out how they landed here, and see if they can repatriate tehir sorry asses as soon as possible.
4) Join the ANC and assist the country in moving country forward and implementing the national democratic revolution.
5) Stop being a counter revolutionary because apartheid has ended, and will not be revived by these cowardly and racist comments.
6) Give your kids a decent life and legacy by behaving like decent human beings............

May i ask which of you have any EVIDENCE that the Honourable Simelane broke ANY law?

Many of you against him speak of the rule of law, yet when the President applies the rule of law (and appoints a man, who by all accounts HAS the necessary qualifications/skills/knowledge), you cry foul. You can't hang a man on opinion (Ginwala Commission) or for the fact that he thinks highly of himself (it's called confidence).

No really guys! This is supposed to be an area for debate, and not somewhere you can throw your racist abuse around. There is a difference between freedom of expression and what is going on here. We need to accept that some people are white and some are black and that we are all entitled to live in this country. We must also agree that people will have different political views. And that is good, and that is what we need in a democracy - we don't want everybody to think the same. But if you cannot have a proper debate you need to get out - I for one don't want to read your racist reviews.

As for the news at hand - the opposition are just doing their job. This is why we have a democracy - so that people from all political parties can have a view.

My point was about the type of comments being made on these forums, many of which smack of intolerance. And I'm not pointing fingers here because it comes from whites and from blacks - from individuals who are for and against the ANC. I just think it is very sad that our differences are continuously being highlighted here, and nobody is talking about our similarities. This is supposed to be an area for constructive debate, not mudslinging and name calling.

Ah Moxster, in future please give me some clue if you are responding to only a single line of my comments instead of of the entire message. That way I won't have to waste my time with inappropriate responses.

It comes down to simple politics - if the opposition isn't happy with government decisions, they will throw their toys. And South Africa is certainly not unique in this instance. Do yourself a favour and look at the vehement debates between the opposition and the ruling party in the UK. But there is a difference between debate, calling people names, and being insulting.

And looking at your PS, I must be an alien then because I've always judged people on their character and not the colour of their skin - I thought that was what the struggle was all about?

Feeling oppressed, suffering, anger etc. are bad, bad guiding emotions for governing a country.
Combined, with a proclivity to corruption and incompetence are perhaps a good way of upsetting the previous dispensation –and also those who supported it, but you have not addressed my earlier question:
Do you honestly believe that we are on the right path to prosperity for all –or even for all your angry, suffering and previously oppressed?

Or do you think that getting back and destroying all that was built by the previous oppressors, by way of stealing, corruption and awful mismanagement takes precedence?

Are you prepared to give an honest answer to give to this vital question, or do you think that spewing forth and practicing your hatred suits you better?
(In all likelihood you are then also one of the corrupt thieves –who uses the whole past apartheid misery as a current pretext to continue your graft and destructive manner)

I agree that a healthy democracy requires vigorous debate and this is what is being seen here. The UK is the best example of open political debate with lots of sting. In the US, everyone had a great time insulting Bush and calling him "village idiot" etc in debates and national TV daily. In SA we are tip toeing and walking on shells over someone calling Zuma a "gangster". It seems that free speech may not have the same definition in SA as it has elsewhere. Many of us in are still in pain over suffering the atrocities of apartheid and cannot fathom that Whites should criticise government. But this there is an intolerance of differing views rather than a melting pot of ideas taking root. How unfortunate for us that we are still hurting each other after all the crap we already went through. Most democracies have checks and balances to avoid corruption. If the NPA head is biased or not independent of the Presidency in any way, it will damage our fragile democracy. My suggestion is we should have some type of confirmation process for these types of appointments to ensure transparency and prevent cronyism.
